Terms of Service

These Terms govern your use of gasder (the ‘Service’). By registering or using the Service, you confirm that you have read, understood, and accepted all conditions herein. If you do not accept, please stop using the Service immediately.

Service provided "as-is"

  • The Service is provided on an "as-is, as-available" basis. We make no warranty that it will meet your specific business needs or be error-free in every situation.
  • Before paying, you should use the free trial and evaluate yourself whether the features fit your needs.
  • We continuously develop and improve features. Some features may be added, changed, or removed at our discretion.

Acceptable use

  • Use the Service only for lawful business purposes.
  • No use for money laundering, tax evasion, or other illegal activity.
  • You are responsible for the security of your account, password, and 2FA credentials.
  • No use that may degrade service for other users (e.g. automated bots, scraping, DDoS).
  • No reverse-engineering, decompiling, or attempting to breach our systems.

Plans and billing

  • Fees are annual, paid in advance, at the rate shown on the Pricing page at signup.
  • Free trial as advertised — cancel before trial ends at no charge.
  • After payment: service continues until end of subscription year. No cash refunds and no credit balance issued under any circumstance. You may choose not to renew.
  • Mid-term upgrades to a higher plan: prorated invoice issued for remaining days, effective immediately upon payment.
  • Downgrading to a lower plan mid-term is not currently supported. You may choose not to renew and sign up to a different plan when your current term ends.
  • Addon fees (extra stations, users, trucks) are billed monthly in arrears. Invoice issued on the 1st of each following month.
  • Payments overdue by 14 days will trigger automatic usage restrictions.

Data ownership + controller/processor roles

  • Your business data (products, inventory, sales, etc.) is yours. We hold it only to operate the Service.
  • Personal data of your customers/partners that you record in the system: you are the "Data Controller" under Thailand’s PDPA. We are merely the "Data Processor."
  • You warrant that you have legal authority to collect and process such personal data (legal basis, minimisation, purpose limitation, consent where required).
  • If your customers exercise PDPA rights against you (access, correction, deletion, etc.), you are responsible to act. The system provides a "PDPA delete" button to assist deletion of personal data.

Data export and retention

  • During subscription: data export features (CSV/Excel) are enabled by plan tier.
  • Before cancellation: customers on any plan may request a full CSV export once by contacting support within 90 days of cancellation notice.
  • After cancellation: access is suspended immediately. Data is retained as read-only for 5 more years, as required by Thai Accounting Act B.E. 2543 and Revenue Code.
  • After 5 years, data is deleted or anonymised. Personal data (name, phone, address) may be deleted earlier if you or the data subject exercise PDPA rights.

Suspension and termination

  • We may suspend or terminate your service for: payments overdue more than 30 days · illegal use · system damage · breach of these Terms.
  • Temporary suspension: we will notify the account owner by email beforehand.
  • Immediate termination: for serious cases (illegal use, fraud, system abuse), we reserve the right to terminate without prior notice.
  • Fees already paid are non-refundable in all termination cases.

Service Level (Best-Effort)

  • We aim for 99.0% monthly availability (best-effort). Excludes: scheduled maintenance with notice · external infrastructure outages · force majeure · cyberattacks.
  • Support responses: best-effort within 2 business days. Customers on plans with "Priority Support" receive faster response.
  • Support channels: Email · In-app.
  • If downtime exceeds the target, we will review case-by-case at our discretion (e.g. extend service period; no cash refunds).

Tax and accounting responsibility

  • The system computes VAT, invoice numbers, and other figures as an assistance only.
  • You are responsible for verifying invoice accuracy, filing ภ.พ.30 (VAT returns), preparing financial statements, and complying with Thai Revenue Department requirements.
  • We are not liable for tax errors, damages, penalties, or interest arising from use of system data.
  • If the system displays incorrect figures, you must verify against source documents (receipts, actual books) before tax filing.

Infrastructure providers

  • We use industry-standard infrastructure providers: cloud hosting · CDN · object storage · email · error tracking · payment gateway.
  • Your data may be processed in data centres in the Asia-Pacific region.
  • Continued use of the Service constitutes consent for us to engage these providers in processing your data.
  • The provider list may change as needed for service operation.

Force majeure

We are not liable for service interruptions caused by force majeure events, including but not limited to: natural disasters · war · terrorism · cyberattacks · ISP/cloud provider outages · government orders · pandemics · widespread power failure.

Limitation of liability

  • We provide the Service as best we can. We are not liable for: lost profits · business interruption · lost opportunity · indirect damages · data recovery costs · punitive damages.
  • Our maximum liability in all cases combined shall not exceed "the fees you paid us in the most recent 3 months."
  • Limitation period: claims must be filed within 6 months of the incident. Late claims are deemed waived.
  • This limit does not apply to cases of willful misconduct or gross negligence as recognised by Thai law.

Indemnification

  • You agree to defend and indemnify us, our officers, employees, and consultants against third-party claims arising from: accuracy of data you record · infringement of your customers/partners rights · breach of these Terms · illegal use of the Service.
  • Including attorney fees · litigation costs · fines · damages awarded.

Changes to these terms

We may update these Terms as needed with 30 days advance notice via email or in-app. Continued use after the effective date constitutes acceptance. If you do not accept the new terms, you may cancel before they take effect (paid fees handled per "Suspension and termination").

Dispute resolution

  • These Terms are governed by Thai law.
  • Before legal action, both parties agree to attempt good-faith negotiation for at least 30 days.
  • If unresolved, disputes shall be subject to the jurisdiction of Thai courts.
